A 20-year-old man from Troms is convicted of raping a 13 year-old-girl and also having offensive pictures showing the sexual acts between children and adults.
The man and the victim used to talk through various chat sites and also over the phone for the duration of 2 months in 2016. He forced the girl to perform sexual acts in front of the webcam.
The violence of children under 14 years has a minimum penalty of three years in prison and a normal punishment of four years. The fact that the man has been convicted of sex offenses against children under the age of 16 is also a clearly aggravating circumstance. A normal reaction would, therefore, have been imprisonment for four and a half years, the district court writes in the verdict.
The man is nevertheless sentenced to 2 years and 11 months in prison, as the case had an exceptionally long lag. After the local linguistic office had spent at least 3 months sending its seized material to specialist researchers in Tromsø, it took another year before the police had the capacity to analyze the seizures.
It also adds some weight to the fact that a criminal conviction and cooperation with the police have been recognized throughout the investigation, the district court writes.
In addition to the prison sentence, the man is ordered to pay 200,000 kroner in reimbursement for the insulted girl.
